Terms of Service

Last updated: 5 October 2026

These Terms of Service (“Terms”) govern your use of the Expivid website, mobile application and related services available through expivid.com (collectively, the “Services”), provided by Expivid (“Expivid”, “we”, “us” or “our”). By creating an account, buying credits or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Accounts

You may need an account to generate videos and spend credits. You are responsible for the information you provide, for keeping your sign-in details secure, and for activity that happens under your account. Accounts are personal and one set of free starter credits is allocated per account.

2. Credits and payments

Video generation is paid for with credits. One-off credit packs are sold through the website and, in the Android app, through Google Play Billing. Credits are not a subscription, are not transferable and have no cash value. Purchased credits never expire; full details are in our credit expiry policy and our refund policy.

3. Your content

You keep any rights you hold in the photos, videos, prompts and other material you upload (“Your Content”). You give us the limited permission needed to store, process and transmit Your Content in order to provide the Services, including sending it to the AI technology providers described in our privacy policy. You must have the necessary rights, permissions and consents for anything you upload, including the consent of any identifiable person shown in a photo you animate.

4. AI Output & Commercial Use

“Output” means the videos and other content that Expivid generates for you from your prompts and uploads.

Ownership. As between you and Expivid, and to the extent any rights in the Output are capable of being granted, Expivid assigns to you whatever rights it may hold in the Output you generate with your own prompts and uploads, subject to these Terms.

Commercial use. You may use the Output for personal and commercial purposes, including social media posts, advertising, marketing material, client work and products, provided your account is in good standing and you comply with these Terms. No attribution to Expivid is required, and no extra licence fee is charged for commercial use.

What you may not do. You may not use the Output to:

  • misrepresent any real person, including creating deepfakes, fake endorsements or sexually explicit depictions of real or identifiable people;
  • infringe copyright, trademark, publicity or privacy rights, including re-uploading third-party footage, logos or characters you do not have permission to use;
  • produce content that is unlawful, hateful, harassing, defamatory, sexually exploitative of minors, or designed to deceive (including scams, fake news or election misinformation);
  • claim that Output depicts real events, or present generated media as authentic documentary footage.

Other people’s rights remain theirs. The Output is generated from your inputs, but the rights in any third-party material that appears in the Output (for example a face, a brand, a song or an artwork included in your uploads) belong to whoever holds them. Your commercial-use rights cover what Expivid adds, not the underlying rights of others.

Originality is not guaranteed. AI generation is probabilistic: similar prompts can produce similar videos, and Output may resemble existing works, other users’ Output or stock footage. Output may not be unique, may not be protectable by copyright under the law that applies to you, and Expivid does not warrant that it is free of third-party claims. Where you use the Output commercially, you are responsible for checking that it is suitable and lawful for your use.

Third-party model terms. Output is produced with third-party AI models. Those providers’ terms also apply to the generation process, and their safety policies may block requests. This does not change your rights in Output that is successfully generated.

Your responsibility. You are solely responsible for how you use the Output, for the prompts and uploads behind it, and for any legal clearance your use requires. You agree to indemnify Expivid against claims arising from your use of the Output or Your Content in breach of these Terms.

Public directory. Stitched or saved videos are private unless you explicitly publish them. Publishing a video to the public directory grants other users a right to view it through the Services; it does not transfer your ownership.

5. Acceptable use

You agree not to misuse the Services: no attempts to breach security or rate limits, no reselling access to the Services without permission, no scraping or bulk downloading of other users’ published videos, and no reverse engineering of the Services. We may suspend or restrict accounts that breach these Terms, abuse free credits, or put the Services or other users at risk.

6. Availability and changes

The Services depend on third-party AI providers, hosting and payment providers, and we may change, suspend or discontinue any feature. Generation speed, quality and availability can vary, and requests may be blocked by provider safety policies (in which case your credits are returned). We aim to keep the Services reliable, but we do not promise uninterrupted or error-free operation.

7. Disclaimers

The Services and all Output are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy. Nothing in these Terms limits rights you have under consumer law that cannot be limited, including the Australian Consumer Law where it applies.

8. Liability

To the fullest extent permitted by law, Expivid is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Services or the Output. Where liability cannot be excluded, it is limited, at our option, to re-supplying the affected Services or the credits spent on the affected renders.

9. Termination

You may stop using the Services at any time and may request account deletion as described in our privacy policy. We may suspend or terminate access for breach of these Terms, suspected fraud or unlawful use. On termination, unused credits follow the credit expiry policy and account closure rules set out there.

10. Changes to these Terms

We may update these Terms from time to time. The current version is always on this page with its “Last updated” date. Material changes apply prospectively; credits you already hold keep the terms they were bought under.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law rules. Nothing in this section prevents you from seeking remedies under consumer law in your place of residence.

12. Contact

Questions about these Terms, licensing or commercial use of Output can be sent to Expivid at gialatosyd@gmail.com, website https://expivid.com.
